4. Hosting

The website, the app and the client gyms' workspaces run on a virtual private server rented by the publisher from Hostinger. Hostinger also provides the mailbox for the firstgym.tech domain.

5. The FirstGym Tech addresses

Three kinds of address, three different roles. The distinction matters:

• firstgym.tech — the publisher's website: product presentation and trial requests. This is the page you are reading.
• app.firstgym.tech — a demonstration instance of the product, open to anyone. The data you see there is fictional and reset every night.
• your-gym.firstgym.tech — a client gym's workspace. The gym is at home there: it chooses its name, logo, colours, prices and the terms it shows its members. We supply the tool; the gym decides how it is used.

6. Intellectual property

What belongs to the publisher

The FirstGym Tech software, its source code, its interfaces, its databases, the text and images on this website, and the name and logo "FirstGym Tech" are the property of PT. LTVT CAPITAL GROUP or are licensed to it. They are protected by copyright and trademark law.

Any reproduction, adaptation, decompilation or distribution, in whole or in part, without prior written permission is prohibited. A subscribing gym receives a right to use the software for the term and within the limits of its contract; that right transfers no ownership of the software.

What belongs to the gym

White-label means the gym puts its own identity into its workspace. Its name, logo, colours, photos, text, menus and prices remain its property. We use them only to run the gym's workspace and, where the gym asks for it, to publish its apps on the App Store and Google Play under its own name.

Third-party trademarks

Other names and trademarks mentioned on this site belong to their respective owners. Mentioning them implies neither partnership nor endorsement.

7. Personal data

How the publisher handles personal data is set out in its privacy policy. It also explains an important distinction: the personal data of a gym's members is not processed by the publisher on its own behalf, but on behalf of the gym, under a data processing agreement.

8. Liability

We keep this site up to date with care. Mistakes and outdated information are still possible: tell us at contact@firstgym.tech and we will fix them.

The information published here is indicative and is not a contractual offer. Service commitments — availability, support, backups, term, price — are those of the contract signed with each gym; this website creates none of them and changes none of them.

This site may link to third-party sites we do not control. Their content and their practices are their publishers' responsibility.

9. Governing law and jurisdiction

The publisher is established in Indonesia. The firstgym.tech website and this legal notice are governed by Indonesian law.

If a dispute arises, we look for an amicable solution first: write to contact@firstgym.tech. Failing agreement, the dispute falls to the competent Indonesian courts for the publisher's registered office (Kabupaten Badung, Bali).

Two reservations, which prevail over the above:

• the contract signed with a gym may designate a different governing law and a different dispute resolution mechanism — in that case the contract applies between the publisher and that gym;
• where a mandatory rule of a user's own country — consumer protection, data protection — grants a right that no contract may set aside, that right remains.
